During his court appearance before judges Karen O’Connor, Elma Sheahan, and Grainne Malone, McGovern faced five distinct charges. Notably, he is accused of murdering Noel Kirwan, who was killed in a shooting linked to the long-standing feud between the Hutch and Kinahan crime gangs in Dublin in December 2016. Reportedly, Kirwan had no prior connections to criminal activity.
In addition to the murder charge, McGovern faces accusations of directing a criminal organization pertaining to Kirwan’s murder, and another charge that involves facilitating the murder itself between October 20 and December 22 of the same year. Two additional charges were also brought against him: directing a criminal organization while monitoring James Gately’s activities and facilitating a conspiracy to murder Gately.
Upon entering the courtroom, McGovern, dressed in a grey T-shirt and tracksuit bottoms, confirmed his identity to the court. His barrister, Olan Callanan BL, indicated that they were reserving their position concerning the legality of McGovern’s arrest and the jurisdiction of the court over the case.
The atmosphere was notably tense; over 20 Garda members were present in the courtroom during this short hearing, underscoring the high-profile nature of the case. Notably, McGovern’s extradition came on the heels of Ireland solidifying its extradition treaty with the UAE.
McGovern was handed over to Gardaí in Dubai on Wednesday and was flown back to Ireland on an Irish military aircraft the following day. Upon landing at Casement Aerodrome in Baldonnel, he was formally arrested by law enforcement officers assigned to investigate Kinahan crime activities. Detective Sergeant Donal Daly testified that he conducted McGovern’s arrest at 6:38 PM.
Following these developments, McGovern has been remanded in custody and is scheduled to appear in court again on June 5 at 11 AM, participating via videolink, as legal proceedings continue to unfold.
